Terms & Conditions

1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

  • "Kithcraft", "we", "us", "our" โ€” the facilitated conversation studio operating under the name Kithcraft, based at Block B-12, Jalan Padungan, 93100 Kuching, Sarawak.
  • "Workshop" or "Service" โ€” any facilitated conversation session, series, or membership offering provided by Kithcraft.
  • "Participant" or "you" โ€” any individual who enquires about, books, or attends a Kithcraft workshop.
  • "Household" โ€” the one or more adults booking or attending as a single unit for the purpose of a Yearlong Membership.
  • "Agreement" โ€” these Terms and Conditions together with any booking confirmation issued by Kithcraft.

2. Acceptance of Terms

By enquiring about or booking a Kithcraft workshop, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. If you are booking on behalf of other household members, you confirm that you have authority to do so and that all household members are adults.

Continued use of our website or attendance at a workshop constitutes acceptance of these Terms.

3. Service Description

Kithcraft provides facilitated conversation workshops designed for educational and reflective purposes. Our services include:

  • New-Parent Conversation Workshop (single session, three hours)
  • Family of Origin Conversation Series (three sessions)
  • Yearlong Family Workshop Membership (twelve-month household membership)

All workshops are facilitative and educational in nature. They do not constitute counselling, psychotherapy, legal advice, medical advice, or any other regulated professional service. Kithcraft facilitators do not provide diagnoses, clinical assessments, or advice on regulated matters.

Services are available primarily in Kuching, Sarawak. We may offer sessions at other locations on an occasional basis, which will be communicated at the time of booking.

4. Participant Responsibilities

As a participant, you agree to:

  • Attend sessions with reasonable consideration for other participants and the facilitator
  • Respect the confidentiality of what other participants share in the session
  • Not record audio, video, or any other media of a workshop session without written consent from Kithcraft and all participants present
  • Provide accurate contact and booking information
  • Notify us of any circumstances that may affect your participation, such as a significant health condition, as early as practicable

Kithcraft reserves the right to ask a participant to leave a session if their conduct is seriously disruptive or harmful to others. In such cases, no refund will be issued.

5. Intellectual Property

All workshop materials, including but not limited to prompt cards, journals, and facilitation frameworks, are the intellectual property of Kithcraft. Participants receive a personal, non-transferable licence to use materials for their own household use. Materials may not be reproduced, shared publicly, or used commercially without written consent from Kithcraft.

Kithcraft does not claim ownership of personal reflections or writings produced by participants during a session.

6. Payment Terms

All prices are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated. Current prices:

  • New-Parent Conversation Workshop: RM 480
  • Family of Origin Conversation Series: RM 1,260
  • Yearlong Family Workshop Membership: RM 2,820

Payment is due in full upon confirmation of booking. We accept bank transfer and such other payment methods as are stated in the booking confirmation. Bookings are not confirmed until payment is received.

Refund and rescheduling policy: We ask for at least 48 hours' notice to reschedule a single session. Cancellations made more than seven days before a session will receive a full refund. Cancellations made within seven days but more than 48 hours before a session will receive a credit note for the value of the session. Cancellations made within 48 hours will not ordinarily be eligible for a refund or credit, except in cases of documented emergency at our discretion. For series and membership bookings, individual sessions may be rescheduled once within the same term at no charge.

7. Workshop-Specific Terms

New-Parent Conversation Workshop: Session length is three hours. The workshop does not include infant care advice, counselling, or any regulated service. Kithcraft takes no responsibility for decisions made by participants in relation to infant care or household management following the session.

Family of Origin Conversation Series: The series comprises three sessions, typically scheduled across three weeks. The follow-up note will be sent to the email address provided at booking, approximately one month after the final session.

Yearlong Family Workshop Membership: The membership covers one household of up to six adults for twelve calendar months from the confirmed start date. Public workshop schedules are published in advance and are subject to change. If a public workshop is cancelled by Kithcraft, affected membership holders will be given priority access to the next available session. Private facilitator sessions must be booked within the membership year; unused private sessions do not carry forward.

8. Disclaimers

Kithcraft's workshops are provided for general educational and reflective purposes. We make no representation that attendance will produce any specific personal, relational, or psychological outcome. The facilitation environment supports structured conversation; it does not replace professional support where that is needed.

Where a participant's needs appear to fall outside the scope of facilitation during a session, the facilitator may note this and suggest that the participant seek appropriate professional support. Kithcraft will not be liable for any decision made by a participant in response to or in the absence of such a suggestion.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Kithcraft's total liability to any participant arising out of or in connection with a workshop shall not exceed the amount paid by that participant for the relevant workshop or membership.

Kithcraft shall not be liable for any indirect, consequential, or special loss, including loss of a relational, psychological, or personal nature, arising from attendance at or non-attendance at a workshop.

Nothing in these Terms limits Kithcraft's liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Kithcraft is not liable for failure to deliver services where that failure is caused by circumstances beyond our reasonable control, including but not limited to illness of facilitators, natural disaster, or government order.

10. Indemnification

You agree to indemnify and hold Kithcraft, its facilitators, and staff harmless from any claims, losses, or expenses arising from your breach of these Terms, your conduct during a session, or any misrepresentation you make in connection with a booking.

11. Termination

Either party may terminate a booking by written notice. Termination by a participant is subject to the refund and rescheduling terms in Section 6. Kithcraft may terminate a booking where a participant has seriously breached these Terms, in which case Kithcraft's liability is limited to a pro-rata refund of any unused and paid-for sessions.

Termination does not affect accrued rights or obligations. Sections 5, 8, 9, 10, and 13 survive termination.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms shall be subject to the jurisdiction of the courts of Sarawak, Malaysia.

Before initiating formal proceedings, we encourage participants to contact us at [email protected] to attempt informal resolution. We commit to responding to any complaint within five business days and to engaging in good faith to resolve it.

13. General Provisions

Entire agreement: These Terms, together with any booking confirmation, constitute the entire agreement between the parties in relation to the relevant workshop.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in force.

Waiver: A failure by Kithcraft to enforce a provision does not constitute a waiver of that provision.

Assignment: Participants may not assign rights or obligations under these Terms. Kithcraft may assign its obligations with reasonable notice.

Notices: Notices should be sent by email to [email protected] or by post to our registered address.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to participants with active bookings by email. Continued use of our website or attendance at a workshop after the effective date of any changes constitutes acceptance of the revised Terms.
